365 BizFund – Terms & Conditions for Application Submissions

By submitting a business funding application to 365 BizFund (“Company”), you (“Applicant”) agree to the following Terms and Conditions (“Agreement”). Submission of any application or document constitutes full acceptance of these terms.

1. Application Accuracy & Authenticity

The Applicant affirms that all information, statements, and documents provided to 365 BizFund are true, complete, and unaltered. This includes all business, financial, and identification records.

Submitting fraudulent or modified documents, including bank statements, is strictly prohibited under N.J.S.A. 2C:21-16 and may be reported to lenders, financial institutions, and law-enforcement authorities.

Administrative Cost Recovery:

If 365 BizFund reasonably determines that any submitted document has been falsified, altered, or intentionally misrepresented, the Applicant agrees to pay a processing and administrative recovery fee of $25 per hour for work performed in good faith prior to discovery.

This fee reflects the actual labor cost associated with underwriting, lender outreach, and documentation review.

2. Offer Acceptance & Withdrawal

If 365 BizFund or any of its partner funders extends a Working Capital approval equal to or greater than the amount requested, and the Applicant elects not to proceed after acceptance preparation has begun, 365 BizFund may charge a reasonable administrative fee of $25 per hour for time spent processing, negotiating, and finalizing the file.

This is not a penalty, but a reimbursement for professional time and resources expended prior to withdrawal.

3. Role of 365 BizFund

365 BizFund acts solely as a commercial funding broker and is not a direct lender.

Our role is to connect Applicants with qualified funding partners based on underwriting criteria.

• Approval, funding amount, and terms are determined solely by third-party funders.
• Submission does not guarantee approval.
• Applicants are under no obligation to accept offers but remain responsible for fees described in Section 2 if applicable.

4. Brokerage Fees & Compensation Disclosure

365 BizFund may receive brokerage, referral, or participation compensation from one or more funding partners in connection with your funded transaction.

Any such compensation will be disclosed upon approval and typically deducted from proceeds at funding.

No upfront or advance fee is charged unless otherwise agreed to in writing.

5. Applicant Authorization

By submitting an application, the Applicant authorizes 365 BizFund and its funding partners to:

• Obtain business and/or consumer credit reports
• Verify submitted financial information and banking activity
• Contact references, lenders, and vendors for verification
• Share documentation with funding partners strictly for underwriting purposes

This authorization remains valid for 90 days from submission.

6. Confidentiality & Data Use

365 BizFund safeguards all Applicant information under applicable state and federal privacy laws.

Data is used exclusively for underwriting and funding purposes and will not be sold or shared outside authorized funding channels.

7. No Guarantee of Funding

365 BizFund does not guarantee that any application will result in an approval, offer, or funding.

All financing is contingent upon third-party review, verification, and available programs.

8. Misrepresentation & Damages

If any material misrepresentation is discovered, 365 BizFund reserves the right to:

• Terminate review immediately
• Invoice the Applicant for administrative costs at $25 per hour
• Recover documented damages and costs of investigation
• Report violations to appropriate agencies or bureaus

9. Governing Law & Venue

This Agreement is governed by the laws of the State of New Jersey.

Any dispute shall be brought in the appropriate court located in Camden County, New Jersey, and the Applicant consents to that venue.

10. Amendments

365 BizFund may update or amend these Terms & Conditions at any time.

Revised terms will be posted on our website and apply to all applications submitted thereafter.

11. Acknowledgment

By submitting an application (electronically or otherwise), the Applicant acknowledges that they have read, understood, and agree to these Terms & Conditions and that all representations are accurate to the best of their knowledge.
